Introduction

The landlord-tenant relationship is one of the most common legal relationships in the United Arab Emirates, especially with the rapid urban growth and large population diversity. This relationship is governed by an integrated legal framework aimed at protecting the rights of both parties and ensuring the stability of the real estate market.

Legal Framework

The rental sector in the UAE is subject to several pieces of legislation, most notably:

  • Federal Law No. (5) of 1985 on Civil Transactions (the chapter related to rent)
  • Law No. (26) of 2007 Regulating the Relationship between Landlords and Tenants in the Emirate of Dubai and its amendments
  • Law No. (20) of 2006 Concerning the Lease of Places in the Emirate of Abu Dhabi and its amendments

Basic Tenant Rights

1. The Right to a Documented Lease Agreement

The tenant has the right to obtain a written and documented lease agreement with the competent authorities. In Dubai, the contract must be registered in the Ejari system, and in Abu Dhabi through the Tawtheeq system.

2. The Right to Use the Property

The landlord is obliged to deliver the property in a condition suitable for the agreed-upon use, and to carry out the necessary structural maintenance throughout the contract period.

3. The Right to Not Be Arbitrarily Evicted

The landlord may not evict the tenant before the end of the contract period except in legally specified cases, such as:

  • Failure to pay rent after the legal notice
  • Damaging the property or using it for illegal activities
  • Subletting without written permission

4. The Right to Renew the Contract

In most emirates, the tenant has the right to renew the lease unless there is a legitimate legal reason to refuse renewal.

5. The Right to a Refund of the Security Deposit

The tenant has the right to a refund of the security deposit (guarantee) at the end of the contract and the delivery of the property in its original condition, taking into account normal wear and tear.

Rent Increase

Rent increases are subject to strict legal controls. In Dubai, the Smart Rent Index issued by the Real Estate Regulatory Agency (RERA) determines the maximum permissible percentage of increase. In Abu Dhabi, rent may not be increased except in accordance with the percentages specified by the competent authorities.

Dispute Resolution

In the event of a dispute between the landlord and the tenant, recourse can be made to:

  • The Rent Disputes Settlement Centre in Dubai
  • The Rent Disputes Settlement Committee in Abu Dhabi
  • The civil courts in the other emirates

Practical Advice

  • Keep a copy of the lease agreement and all correspondence with the landlord
  • Document the condition of the property upon receipt with photos and videos
  • Do not sign any amendment to the contract without legal review
  • Make sure to register the contract with the competent authorities
