Abu Dhabi Rental Law: Landlord and Tenant Rights

Introduction

The rental relationship in the Emirate of Abu Dhabi is governed by Law No. (20) of 2006 concerning the lease of premises and its amendments, in addition to the regulatory decisions issued by the Department of Municipalities and Transport. This legal framework aims to achieve a balance between the rights of the landlord and the tenant.

Registration of the Lease Agreement

Tawtheeq System

  • All lease agreements must be registered in the "Tawtheeq" system of the Department of Municipalities and Transport.
  • Registration is mandatory and gives the contract legal authority.
  • Registration can be done electronically through the "TAMM" platform.

Required Data

  • Landlord and tenant data
  • Description and area of the property
  • Annual rent value and payment method
  • Duration of the contract and renewal conditions

Landlord's Rights

1. Receiving the Rent on Time

  • The landlord has the right to demand the rent on the agreed-upon dates.
  • In case of delay, he can officially notify the tenant.

2. Recovering the Property

The landlord has the right to request eviction in the following cases:

  • Failure to pay the rent after the notice (30 days)
  • Violation of the terms of the contract
  • Damage to the property
  • Subletting without permission
  • The landlord's desire to demolish the property and rebuild it
  • The landlord's desire for personal residence (under specific conditions)

  • The tenant must be notified 90 days before the end of the contract.
  • The maximum percentage of the increase is determined by the competent committee.

Tenant's Rights

1. Quiet Enjoyment of the Property

  • The landlord is obligated not to interfere with the tenant throughout the contract period.
  • The property must be delivered in a usable condition.

2. Maintenance

  • The landlord is responsible for structural and essential maintenance.
  • The tenant is responsible for simple and operational maintenance.

3. Renewal of the Contract

  • The tenant has the right to renew the contract unless there is a legal reason for refusal.
  • The tenant must be notified of non-renewal 90 days in advance.

4. Refund of the Security Deposit

  • The tenant has the right to a refund of the security deposit upon handing over the property.
  • The value of any damage exceeding normal wear and tear is deducted from it.

Resolution of Rental Disputes

Rental Disputes Settlement Committee

  • A competent body to consider rental disputes in Abu Dhabi.
  • Simplified and fast procedures compared to ordinary courts.
  • Its decisions are binding and subject to appeal.

Steps

  1. Submit an electronic complaint through the "TAMM" platform.
  2. Attempt an amicable settlement.
  3. Hearing session before the committee.
  4. Issuance of the decision.

Practical Advice

  • Register the lease agreement in the Tawtheeq system immediately.
  • Keep receipts for rent payments.
  • Document the condition of the property with photos upon receipt and delivery.
  • Do not accept any verbal modification to the contract.
  • Consult a lawyer in the event of any dispute.
